Mediation is a process used to resolve disputes. The opposing couple utilizes mediation to arrive at mutually agreed upon terms. Mediation is a fair process in which the parties discuss and decide for themselves the arrangements for their children, support and property division. The parties jointly hire a mediator to act not as the attorney for either or both, but as a neutral mediator. During mediation, the couple works out a mutually satisfied plan covering all outstanding issues of the parties. Both are free to consult with a lawyer or other adviser at any time. The process is designed to reduce the adversarial element often encountered in a divorce or subsequent legal proceeding and in doing so, it saves time and money. Once an agreement is reached, the mediator will write a draft for the parties to review with his or her lawyer before signing. Attorney Azzari can assist the couple further by preparing their Joint Petition for Divorce and accompanying forms that they can submit to the court. |
